Premarital Agreements

Guardianships
Sometimes a family member, usually a child, needs to be in the custody of a non-parent for a short or an extended period of time. The custodian needs legal rights in order to properly act as a substitute parent while he or she has responsibility for that child. Medical emergencies, school documents, athletic consent forms almost always require a parent or legal guardian to execute the proper documents. Also, you may need a guardianship over an elderly or disabled member of your family, so that you can properly care for him or her. We can help you get a guardianship set up to make sure the guardian has all necessary legal rights, while protecting the rights of the child or other person (known as the ward) and of the parents or other close relatives of the ward.

Divorce
Like it or not, divorce is a fact of modern life. In the unfortunate event that you need or decide to get a divorce, we can help you work through this process with the least amount of pain possible: Who gets the house, or do we sell it and split the proceeds? Who gets the family heirlooms, the piano, the new pickup truck or the furniture? How do we divide all this stuff up? How much alimony should be paid? What about those retirement accounts? Who gets the tax write offs, and who gets custody of the kids? We will try to negotiate a reasonable settlement of all of the issues. But if the parties can't agree, we are fully prepared to go to court to protect your rights and get you the best resolution possible.

Child Custody
Will you have joint legal custody or primary custody in one spouse with visiting rights for the other spouse? Where will your children be on Christmas, Easter, Chanukah, summer vacation, Thanksgiving, and other holidays? What about weekends? What school will the kids attend? What church will they attend? Who gets the tax write-off? How much child support should be paid, and by whom? What if one spouse moves to a different state? Do the grandparents have any legal rights? We'll make sure these questions get answered in the divorce decree so that there won't have to fighting and confusion afterwards. We'll try to settle all these matters out of court, but again, if your spouse insists on being unreasonable, we'll fight for your rights in court.

Mediation
Mediation allows both parties in a dispute to meet with a neutral third party called a mediator to work out their differences. Unlike an arbitrator, a mediator is there only to facillitate an agreement between parties, not to rule a judgement.
